EB-3 PERM Audit: Common Triggers and How to Respond

DOL may audit a PERM and require recruitment evidence. An audit delays timing, and complete documents do not guarantee approval. Triggers and an employer checklist.

Short answer: A PERM labor certification may be audited by the U.S. Department of Labor (DOL). If selected, the employer must submit the ads, résumé-handling records, recruitment report and related evidence by the deadline. An audit is not an automatic denial, but it significantly lengthens PERM timing. Prevention means recruiting by the rules from day one with a traceable file. DOL does not publish its selection criteria.

Why do PERM audits happen?

DOL does not publish its selection criteria. In general, a case may be selected at random or because of what the application contains, such as unusual or restrictive job requirements, wage issues, or questions about past recruitment. Whatever the reason, response windows are short. The audit letter states the deadline (normally 30 days; rely on the letter itself), and reconstructing ads after the fact is often impossible. For the full process, see the PERM step-by-step guide.

What documents do audits usually request?

| Type | Examples |
| State workforce agency job order | A 30-day job order with the State Workforce Agency (SWA) |
| Newspaper ads | Two print ads on Sundays (non-professional occupations) |
| Internal notice (Notice of Filing) | Record of the notice posted at the worksite for 10 consecutive business days |
| Résumés and screening | Résumés received, rejection reasons, interview notes |
| Recruitment report | Required narrative of the recruitment results |
| Other | Job description, prevailing wage basis |

These are the basic recruitment steps for non-professional occupations, including Other Workers; professional occupations require three additional recruitment steps. The employer must keep PERM records for 5 years (20 CFR 656.10(f)).

Does an audit change my priority date?

No. The priority date is the date the PERM was filed with DOL. An audit does not change it but delays certification and the I-140 filing.

How do employer and employee roles divide?

PERM is the employer's application. By law the employer must pay all PERM costs and may not charge the worker (see who pays EB-3 costs). The employee should provide accurate résumé and credential documents and must not "help" fabricate recruitment records. The employer's attorney of record usually coordinates the file so ad text matches the PERM form and the later I-140.

How should the employer prepare?

Treat every recruitment as audit-ready: archive ad screenshots, run dates and résumé logs the same day, and do not wait for an audit letter to start. If audited, answer the full list on time; a single missing item can lead to denial or a request for more evidence. For an example of how an audit response is handled, see passing a PERM audit; for the wage side, see the prevailing wage explainer.

Frequently asked questions

Does an audit mean my PERM will be denied?

No. An audit is DOL asking for recruitment evidence. Complete documents do not guarantee approval, but a full, traceable file improves how well the employer can respond.

Does my priority date change during an audit?

No. The priority date is the PERM filing date; an audit only delays certification.

How long is the deadline to respond?

Normally 30 days, but rely on the date in the audit letter. A missed deadline can lead to denial.

Do I have to pay for the audit response?

No. By law the employer must pay all PERM costs and may not charge the applicant.

How long must the employer keep recruitment records?

Five years under DOL rules.
