EB-3 vs EB-2 in 2026: Requirements, Employer, Dates

EB-2 needs a job requiring an advanced degree or exceptional ability; EB-3 covers skilled, professional and other workers. Compare both Visa Bulletin rows side by side.

Short answer: An EB-2 job must require an advanced degree or exceptional ability, while EB-3 covers skilled workers, professionals and other workers. Both usually need an employer and labor certification. The EB-2 National Interest Waiver (NIW) is the exception, but it generally does not fit ordinary entry-level jobs.

Which category has the higher threshold?

Generally EB-2 sets a higher bar on the job's education or ability requirements, while EB-3 covers a wider range of skilled and unskilled permanent jobs. A higher bar does not mean faster or slower. Waiting time depends on country of birth and the current Visa Bulletin.

Do both need an employer?

Regular EB-2 and EB-3 both need an employer and labor certification. The EB-2 NIW can waive both when the applicant shows the work is in the national interest, but that is a demanding standard and not an option for an ordinary job.

Can an EB-3 Other Workers job move to EB-2?

Generally no. The category is set by the job's minimum requirements. An Other Workers job requires less than two years of training, so it cannot meet EB-2's advanced degree or exceptional ability standard, and an entry-level role rarely supports an NIW. See what Other Workers means.

Which category has the shorter wait?

There is no fixed answer. For the same country of birth, EB-2 and EB-3 final action dates can lead or trail each other from month to month. For reference, in the October 2026 Visa Bulletin the EB-3 Other Workers final action date for most countries (including Taiwan, Hong Kong and Macau) is 1 January 2022, with a Dates for Filing of 1 June 2022, and mainland China is 1 October 2019. Look up the EB-2 row of the same bulletin for EB-2 dates.

Compare the final action dates of both rows side by side. If EB-2 is slower, ask an attorney whether filing in EB-3 makes sense. EB-3 is not always slower, and a higher category should not be forced onto a job that does not support it.

Are the family rules the same?

Derivative rules are similar: a spouse and unmarried children under 21. Plan for the risk of a child aging out whenever the wait is long, whichever category you choose.

Frequently asked questions

Does EB-3 always need a U.S. employer?

Generally yes. A U.S. employer must offer a permanent full-time job and complete labor certification and the I-140.

I have a master's degree. Can I file in EB-2?

It depends on whether the job requires an advanced degree, not just whether you hold one. The job's minimum requirements decide it, and the employer's attorney should assess this.

Which should I choose if I fit both?

Compare both final action dates and job stability, and talk to an attorney. Sometimes both lines can be considered.

Can EB-3 guarantee approval?

No. Every category requires meeting the legal criteria and passing review, and results vary by case.
