Can You Work While Your EB-3 Adjustment Is Pending? (EAD)

Filing an I-485 does not by itself let you work; you need an approved EAD (Form I-765). Consular applicants become permanent residents on entry and never need an EAD.

Short answer: While an adjustment of status (I-485) is pending in the U.S., filing the I-485 alone does not authorize work. You generally need an approved EAD (employment authorization document, Form I-765) or another valid work status. Applicants who process through a U.S. embassy or consulate abroad become permanent residents when they enter on the immigrant visa and can work immediately, so they do not need an EAD.

Can I work as soon as I file the I-485?

Not automatically. A pending I-485 lets you stay in the U.S. while you wait. You can file Form I-765 (category (c)(9)) together with the I-485. When the card arrives, check the validity start date before you begin working. If you already hold a work status such as H-1B, plan the transition separately.

How is an EAD different from Advance Parole?

DocumentMain purpose
EAD (Form I-765)Permission to work
Advance Parole (Form I-131)Permission to return after travel abroad

They can be requested together, but approval and use rules differ. Leaving the U.S. without Advance Parole while an I-485 is pending can be treated as abandoning it, with exceptions such as people maintaining valid H-1B or L-1 status. Ask an attorney before you travel.

How long does an EAD take?

Processing times change and there is no fixed number of days. Check I-765 times under "Check Case Processing Times" on the USCIS website. EAD validity periods and the automatic extension of expiring EADs have changed recently, so follow current USCIS guidance. For renewals, it is generally advised to file about 180 days before expiry and not to assume an automatic extension.

Do applicants abroad need an EAD?

No. An EAD relates only to adjustment of status inside the U.S. Applicants processed abroad enter on an immigrant visa as permanent residents and can work right away. Many applicants from Taiwan, Hong Kong and China follow this route; see the process.

Can my spouse work?

Not automatically. Your spouse and children must each file their own I-485; the spouse must also file an I-765 and have it approved before working. If the principal applicant is in H-1B status, an H-4 spouse may have another work-permit route if eligible; follow current rules.

Frequently asked questions

Must I file the I-765 and I-485 together?

You can, and it is usually the most efficient. You may also file the I-765 later while the I-485 is pending.

How do I renew an EAD?

Generally file about 180 days before expiry and check current USCIS rules first.

Can I change jobs while waiting (AC21)?

Once the I-485 has been pending 180 days or more and the I-140 is approved, you may move to a same or similar occupation (INA 204(j)). Ask an attorney first.

Does premium processing skip the line?

No. Premium processing only shortens adjudication of certain filings, such as the I-140; it does not change your priority date or make your date current.

Is approval guaranteed?

No. You must meet the legal requirements and pass review; results vary.
