EB-3 Adjustment of Status vs Consular: Travel and Family

Only people in the U.S. who qualify can consider I-485. People abroad use NVC and a consulate. Compare eligibility, travel, work permits and family planning.

Short answer: After the I-140 is approved and your priority date is current, EB-3 has two paths: adjustment of status (I-485) in the U.S., or consular processing (NVC plus an interview) abroad. Only people in the U.S. who are eligible can consider I-485; people in Taiwan, Hong Kong and similar places usually use the consulate. Neither path is "higher". What controls is where you are and whether your status allows it.

This article focuses on eligibility, travel, work permission and family planning. For the step-by-step consular process, see consular processing vs adjustment of status. It is general information, not legal advice.

How do the two paths differ?

| Item | I-485 in the U.S. | Consular processing abroad |
| Who it suits | In the U.S. and eligible to adjust | Mainly people abroad |
| Work / travel | May apply for an EAD and Advance Parole | No new U.S. work or residence rights until the visa is issued and you enter; you rely on your existing status |
| Interview | USCIS may call an interview | Consular interview is standard |
| Medical exam | Civil surgeon in the U.S. (I-693) | Panel physician (DS-2054) |
| Risk points | Status or unauthorized-work problems can block adjustment | Medicals, civil documents, appointment timing |
| Job change | After the I-485 has been pending 180 days, a move to a same-or-similar job may be possible (AC21) | Considered only after entry |

Who should not assume they can use I-485?

Most applicants must have been inspected and admitted or paroled. Failure to maintain status or unauthorized work may block adjustment. For employment-based cases limited violations are excused under INA 245(k), but not all, even with an approved I-140. An attorney must assess this before an I-485 is filed, because a wrong filing can have serious consequences.

What are the key travel differences?

Leaving the U.S. while an I-485 is pending, without valid Advance Parole (or another protection, such as certain visa statuses), can be treated as abandoning the application. Consular processing is completed abroad, and you enter with the immigrant visa. Dual-intent statuses such as H-1B and L-1 add flexibility, but they still need a planned strategy.

Does the whole family need the same route?

Not necessarily, but plan it together. A spouse in the U.S. may be able to adjust while a child abroad uses a consulate. Check the whole family's route with an attorney first, and see spouse and children.

What do we recommend?

Confirm whether your priority date is current (for adjustment, USCIS may allow filing under the Dates for Filing chart), where each family member is, and whether any bar to adjustment exists. Most Taiwan and Hong Kong applicants should plan on consular processing and start police certificates and civil documents early. Do not assume I-485 is available merely because you are in the U.S.

Frequently asked questions

If I am in the U.S., can I always file I-485?

No. You must meet entry and status conditions, and an attorney should review your facts case by case.

Can I leave the U.S. while the I-485 is pending?

Leaving without valid Advance Parole or another protection can be treated as abandoning the application. Ask an attorney before you travel.

Can I work in the U.S. while consular processing is underway?

There is no new U.S. work right until you enter with the immigrant visa. Rely on your existing status, and do not enter on a tourist or student visa planning to switch.

Can I change jobs while the I-485 is pending?

In some cases, after 180 days, you may move to a same-or-similar job (AC21). Ask an attorney first; see [AC21 job portability](/en/blog/eb3-ac21-job-portability-2026/).
