EB-3 Job Change While Green Card Pending: AC21 (2026)
With an I-485 pending 180 days and an approved (or approvable) I-140, AC21 may let you move to a same or similar job. It does not apply to consular cases.
Short answer: If your I-485 has been pending in the U.S. for 180 days, the underlying I-140 is approved (or was approvable) and you meet AC21 (INA 204(j)) rules, you may be able to move to a bona fide permanent full-time job in the same or similar occupational classification, documented on Form I-485 Supplement J, without a new PERM for the new employer. This is not "change whenever you want": similarity of occupation, a genuine offer and proof all matter.
This article is for people who have already filed an I-485. Most Other Workers applicants from Taiwan and Hong Kong are abroad and use consular processing, to whom AC21 does not apply; see below.
What problem does AC21 address?
During long green card waits, there can be layoffs or broken employer relationships. AC21 gives limited job portability so qualifying I-485 applicants can change jobs without abandoning the case. It applies only to adjustment of status after an I-485 has been filed. An applicant abroad in consular processing cannot port to a new employer, and a job change there generally needs a new PERM and I-140. Because most Other Workers go through consulates, relatively few hold a pending I-485. For when an I-485 can be filed, see concurrent filing.
Questions before you rely on it
| Question | Why it matters |
| Has the I-485 been pending 180 days? | Statutory timing gate |
| Is the I-140 approved (or approvable)? | Prerequisite for AC21 |
| Is the new job in the same or a similar occupation? | Core legality |
| Is it a genuine permanent full-time offer, documented on Supplement J? | Basis of the immigrant category and paperwork |
| How will you document it? | Interview or an RFE may demand proof |
Common myths
- Thinking PERM approval alone lets you switch employers freely: portability is generally tied to an I-485 that has been pending 180 days.
- Thinking identical job titles equal "similar": duties control.
- Thinking a job change before day 180 is protected: it is not. Leaving before 180 days, or moving to a different occupation, can lead to denial or abandonment of the I-485.
- Thinking the old I-140 stops mattering after a job change: once the I-485 has been pending 180 days, an approved I-140 generally stays valid even if the first employer withdraws it, but only if the new job qualifies.
What should I keep on file?
Before resigning or accepting a new role, get a written AC21 assessment from immigration counsel, not after you quit. Keep the new offer, job description, org chart and payroll records. USCIS does not extend RFE deadlines, so act with your attorney as soon as a notice arrives. Consular-path applicants should not apply internet "180-day rules" blindly.

Frequently asked questions
I am in Taiwan and going through consular processing. Can I use AC21 to change employers?
No. AC21 applies only after an I-485 has been filed. For an applicant abroad, changing employers generally means a new PERM and I-140.
What happens if I change jobs before the I-485 has been pending 180 days?
AC21 does not protect you, and it can lead to denial or abandonment of the I-485. Speak to an attorney first.
Which form documents the new job?
Generally Form I-485 Supplement J, which describes the new bona fide permanent full-time job offer.
Can the new job be in a completely different field?
It generally must be in the same or a similar occupational classification. Whether it qualifies depends on the actual duties, so have an attorney assess it.
